簽訂買賣合同,然後登記過戶。
破產房地產一般都是通過拍賣途徑購得的。到時競標成功後,拿競標書和房產證即可到當地的房地產交易所辦理過戶手續。

⑤ 如何購買破產房產

房地產企業一旦破產,房屋是否建成就決定了該企業事實上是否可能履約。以下將分這兩種情況進行討論。

一、房屋已建成

房屋已經建成的情況下,破產企業即有對購房人履約的可能,也就是業主有可能能夠拿到房子。

二、房屋未建成

若企業破產宣告時房屋尚未建成,或人民法院受理破產申請後,管理人決定不再繼續修建未建成的房屋,就會造成破產企業對購房人債務履行事實不能的情況。根據房屋的買受方式不同,可以區分為兩種情況:按揭貸款買房和對賣方分期付款買房,這兩種買房的方式會對房地產企業破產時,房屋的權利歸屬產生不同影響。

1、按揭貸款所購房屋的權利歸屬。

企業破產時房屋的權利歸屬。現房按揭中,開發商破產對房屋的權利歸屬沒有任何影響。購房人僅需繼續向銀行清償債務,並以房屋為擔保即可。

期房按揭中,購房時房屋尚未建成,購房人不享有房屋的所有權。當房屋建成後,若房款已經付清(購房人支付了首付,貸款銀行以購房人的名義付清了餘款),購房人即可委託開發商向當地房地產登記處申領《房地產證》並取得房屋所有權。之後房地產企業的破產對房屋的權利歸屬亦不生影響,購房人僅需繼續向銀行清償債務,並以房屋為擔保即可。

2、對賣方分期付款買房時房屋的權利歸屬。

與按揭買房不同,在分期付款購房的情形下,在轉移所有權之前,根據破產申請受理時,購房人是否足額支付價款可以分為以下兩種情況討論:

第一,購房人已經付清全部價款的,所購房屋被排除在破產財產之外,購房人可以要求破產管理人轉移房屋所有權,並向房地產管理部門申請變更房屋登記。

第二,購房人尚未付清全部價款的,房地產企業尚未轉移所有權,雙方均未履行完畢合同,破產管理人即有權決定是解除合同還是接受價款並轉移房屋所有權。

其次、你得告訴我你是不是買二手房
第三、如果你是買二手房那你就要看你自己本身的信用記錄,然後你得找一家審理貸款不是很嚴格的銀行
第四、具個例子教你,比如你的房價是20萬,那你的受付則是6完,一般來說,貸款是簽5本買賣合同的,你其中一份做房屋買賣的總價是26萬,然後給銀行審批貸款,銀行則會請評估公司對你現在成交的房子進行評估,如果評下來沒有問題,你的信用記錄也很好的話,銀行則可以給你貸出26萬
第五、你可以在買賣合同里和你的上家約束,先做交易,後過戶。因為銀行一般都是等你們上下家把產權證過戶手續辦完等新的產權證和他項權利證明出來了才放款。一般來說你的上家是不肯的,那就要靠你自己怎麼去說了。如果解決了這個問題的話,基本上你不用付首付就可以買房了

1.買入時機

對於房地產投資者來說,確定最佳的購買時機是非常重要的。最佳的房地產購買時機,就是成交價比預期購買價要低,也就是說以較低的價格買進房地產,從而減少本金。房地產價格不同於股票,很少有大起大落的現象,它有其自身的特點和規律,一般來說,下列情況是投資者購買房地產的最佳時機:

(1)開發時期。房地產剛開發時期,大多數人對該地區價值認識不足,因而其價格常常受到壓抑,其市場價格往往低於實際價值,而且人們的購買力尚未轉入該地區的房地產市場,所以需求者相對較少;另一方面,房地產開發商一般都急於回收資金歸還銀行貸款,清償各種債務,願意以較低價出售。但當人們的購買力投入該地區房地產市場後,購買需求將增加;同時,隨著房地產開發進程加快,投資資金的不斷湧入,從需求、供應兩方面推動房地產價格直線上漲。因此,房地產剛開發時期是低價買入房地產的有利時機。

(2)經濟蕭條時期。當社會經濟蕭條時,人們整體投資水平將下降,購買力也會下降,人們對房地產的需求減少,於是,房地產價格下跌。反之,當經濟逐漸復甦,人們的購買力將上漲,投資也會逐步上升,相應的人們對房地產的需求增加,房地產價格上漲。所以,經濟蕭條時期是低價買進房地產的大好時機。

(3)在通貨膨脹到來之前。通貨膨脹使物價持續上漲,實際上是一種「泡沫經濟」,常常引起貨幣貶值。通貨膨脹通常也會引起房產價格上升。但通貨膨脹時間一般不會長久,國家會通過各種宏觀手段如提高利率等措施來抑制通貨膨脹。因此房產價格上漲也是比較短暫的,漲到一定程度會隨著通貨膨脹的抑制而停止甚至下跌。房產投資者如果能對經濟形勢有比較全面的了解,在通貨膨脹到來之前買入房產,那麼,當通貨膨脹發生時你所購入的房產將以較大幅度增加價值。

2.賣出時機

房產最佳賣出時機是在房地產價格波動中的高峰時賣出,即「貴時賣出」。如果投資者在買入房產時抓住了有利時機,然後又在應該賣出時及時賣出,那麼,一買一賣便是成功的投資。一般下列情況是房產賣出的較好時機:

(1)房產市場價格大於目標賣價或預期賣價。目標賣價就是你參考原市場價格所制定的某一具體價格;預期賣價就是你在心裡計劃拋售的價格。在房產市場價格大於目標賣價時賣出可以使你獲得目標利潤,但這並不一定是賺取最多利潤的時機。

(2)經濟高漲時期。經濟高漲時期各個行業投資上漲,對房產的需求相對增大。由於需求增加,房產價格上漲也就很自然。如果投資者在經濟高漲時拋售房產,然後在經濟下滑之前時購入,那麼你也許擁有更多數目的房產,或手中的資金增加了許多。

(3)通貨膨脹時期。通貨膨脹對持有大量貨幣的人的心理會產生震動,認為貨幣會貶值,錢不值錢了,還是變成實物安全得多,而房產往往被人們認為是最具有長期、穩定價值的實物。特別是在通貨膨脹較為嚴重時期,人們為了避免貨幣貶值的損失,達到保值、增值的目的,會急於將自己的錢變為實實在在的實物,大多數人會選擇購買房產,大量資金會湧入房產市場,使房產市場供不應求,加上通貨膨脹本身帶來的房產價格上揚的自然因素,促使房產價格上升到非常高的水平。對持有房產的投資者來說,此時將房產賣出無疑是最好的時機,可以獲得豐厚的利潤。

人們知道,投資房地產只有「賤買貴賣」才能獲得厚利,可是在實際的交易中,大概是因為人的慾望做怪,反其道而行之者數不勝數。當某種房產非常有利時,反而很少有人問津,而敢於大量吃進者寥若晨星。他們擔心房產下跌之勢會不會繼續下去,猶豫旁觀,遲遲做不了決定;即使買了,也是擔驚受怕。誰知,不久房產價格連續上漲,要買又買不到了,眼睜睜地看著收益從眼前流失。

不少人有隨眾心理,喜歡在樓市上漲時購買房產,以為其他投資者都在賺錢,跟著別人也能賺上一筆。這樣做有時是可以賺到錢,但是,這種做法的缺陷是即使獲了利,比起下跌時購買,賺得少多了;而且這種跟著別人盲目購買,風險性很大。因為,房產價格越是暴漲,在某一時刻回跌的危險性就越大。
